Introduction

In order for our community to thrive, a certain amount of trust is required. We want to continue offering users access to as many interactive features as possible, so that all of you can help shape the future of corvette.com.sg (the “Website”).

Have fun out there — but please don’t abuse the Website. Read these rules carefully and take them seriously. Don’t try to find loopholes; the rules exist to support a welcoming, respectful space for all who are interested in the Website.

Violations of these user guidelines may result in a warning or, at our sole discretion, the termination of your account and deletion of any or all of your content. If your account is terminated, you are prohibited from registering for another Website account.

1. Your Acceptance

By using and/or visiting this Website:

  1. You agree to and accept these terms and conditions (the “Terms of Service”); and
  2. You acknowledge that you have read, understood, and agreed to our Privacy Statement found at corvette.com.sg/privacy-statement, and agree that your personal data will be collected, used, and disclosed in accordance with the Personal Data Protection Act 2012 of Singapore.

If you do not agree to any of these Terms of Service or the Privacy Statement, please do not use the Website.

The Website is operated by Alpine Motors Pte. Ltd. (UEN 199206358D) (“Alpine Motors”), through various agencies and service providers.

These Terms of Service apply to all users of the Website.

The Website may contain links to third-party websites that are not owned or controlled by Alpine Motors (“Third Party Websites”). Alpine Motors has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any Third Party Websites.

In addition, Alpine Motors does not and cannot review, censor, or edit the content of any Third Party Website. By clicking on such links, you expressly release Alpine Motors from any and all liability arising from your use of, or reliance on, any Third Party Website or its content.

We encourage you to exercise caution when leaving the Website, and to review the terms and privacy policies of any websites you visit.

3. Accounts

To access certain features of the Website, you may be required to create an account. You may not access or use another user’s account without their express permission.

When creating an account, you must provide accurate and complete information. You are solely responsible for all activity that occurs under your account and must maintain the confidentiality of your password.

You agree to notify Alpine Motors immediately of any actual or suspected breach of security or unauthorized use of your account.

Alpine Motors is not liable for any loss or damage arising from your failure to safeguard your account credentials. However, you may be held liable for losses incurred by Alpine Motors or others due to unauthorized use of your account.

4. General use of the Website – Permissions and Restrictions

Alpine Motors hereby grants you permission to access and use the Website as set forth in these Terms of Service, provided that:

  1. You agree not to alter or modify any part of the Website.
  2. You agree not to access Website content by any means other than the user interfaces provided on the Website itself.
  3. You agree not to use the Website for any commercial purpose without prior written authorization from Alpine Motors. Prohibited commercial uses include, but are not limited to:
    • The sale of access to the Website or its services on another website;
    • Use of the Website or its services primarily to generate advertising or subscription revenue;
    • The sale of advertising on the Website or on any third-party website that targets Website content;
    • Any use of the Website or its services that, in Alpine Motors’ sole discretion, exploits its resources to compete with or displace the market for Website content, products, or services.
  4. Prohibited commercial uses do not include:
    • Any use expressly authorized in writing by Alpine Motors.
  5. You agree not to use or launch any automated system, including but not limited to “robots,” “spiders,” or “offline readers,” that accesses the Website in a manner that sends more request messages to the Website’s servers in a given time period than a human can reasonably generate using a standard web browser.
  6. Notwithstanding the foregoing, Alpine Motors grants public search engine operators permission to use spiders to copy materials from the Website solely for the purpose of creating publicly available, searchable indices. Alpine Motors reserves the right to revoke this permission at any time, in whole or in part.
  7. You further agree not to collect or harvest any personally identifiable information from the Website, nor to use its communication systems (e.g., comments, email) for commercial solicitation. You agree not to solicit Website users for commercial purposes.
  8. You will otherwise comply with these Terms of Service and all applicable local, national, and international laws and regulations.
  9. You agree to comply specifically at all times with the Personal Data Protection Act 2012 (PDPA) and the Computer Misuse Act 1993 (CMA) of Singapore, including but not limited to refraining from unauthorized access, modification, or misuse of data and information.
  10. Alpine Motors reserves the right to modify or discontinue any aspect of the Website at any time.

5. Your use of Content on the Website

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of content on the Website:
  1. The content on the Website — including, without limitation, text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and similar materials (“Content”) — as well as the trademarks, service marks, and logos contained therein, are owned by or licensed to Alpine Motors, and are protected by copyright and other intellectual property laws.
  2. You may access user submissions solely:
    • for your information and personal use;
    • as intended through the normal functionality of the Website; and
    • for Streaming.
    “Streaming” means a contemporaneous digital transmission of an audiovisual work via the internet from the Website to a user’s device, in such a manner that the content is intended for real-time viewing and not for copying, storing, downloading, or redistributing by the user. Accessing user videos for any purpose or in any manner other than Streaming is expressly prohibited.
  3. You may access Website Content only as permitted under this Agreement. Alpine Motors reserves all rights not expressly granted in and to the Website Content.
  4. You agree not to engage in the use, copying, or distribution of any Content except as expressly permitted under these Terms of Service, including any use, copying, or distribution of Content obtained through the Website for commercial purposes.
  5. You agree not to circumvent, disable, or otherwise interfere with security-related features of the Website, or with features that prevent or restrict the use or copying of any Content, or that enforce limitations on the use of the Website or the Content therein.

To file a copyright infringement notification with us under Section 308 of the Copyright Act 2021 (Singapore), please send a written communication that includes the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner of the allegedly infringed work.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material on the Website that is claimed to be infringing, including information reasonably sufficient to allow us to locate the material.
  4. Information reasonably sufficient to allow us to contact you, such as your mailing address, telephone number, and email address (if available).
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and that you are authorized to act on behalf of the copyright owner, made under penalty of perjury.

7. Account Termination Policy

Alpine Motors reserves the right to terminate a user’s access to the Website if, under appropriate circumstances, they are determined to be a repeat infringer.

Alpine Motors also reserves the right to determine, in its sole discretion, whether Content is appropriate and complies with these Terms of Service for violations other than copyright infringement or intellectual property violations. This includes, but is not limited to, Content that is pornographic, obscene, defamatory, or excessively long.

Alpine Motors may remove any content from the Website and/or terminate a user’s access for submitting material that violates these Terms of Service, at any time, without prior notice and at its sole discretion.

8. Warranty Disclaimer

You agree that your use of the Website is at your sole risk. To the fullest extent permitted by law, Alpine Motors, its officers, directors, employees, parents, affiliates, shareholders, representatives, and agents disclaim all warranties, express or implied, in connection with the Website and your use thereof.

Alpine Motors makes no warranties or representations regarding the content of any Third Party Websites linked to or from this Website, and assumes no liability or responsibility for any of the following:

  1. Errors, mistakes, or inaccuracies of content;
  2. Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of the Website;
  3. Unauthorized access to or use of our secure servers and/or any personal or financial information stored therein;
  4. Interruption or cessation of transmission to or from the Website;
  5. Bugs, viruses, Trojan horses, or similar harmful code transmitted to or through the Website by any third party; and/or
  6. Errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Website.

Alpine Motors does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Website or any hyperlinked website, or featured in any banner or other advertising. Alpine Motors will not be a party to or in any way responsible for monitoring any transaction between you and third-party providers of products or services.

As with the purchase of any product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

9. Limitation of Liability

Alpine Motors, including its parents, subsidiaries, affiliates, officers, directors, employees, and agents, shall not be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any of the following:

  1. Errors, mistakes, or inaccuracies of content;
  2. Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of the Website;
  3. Unauthorized access to or use of our secure servers and/or any personal or financial information stored therein;
  4. Interruption or cessation of transmission to or from the Website;
  5. Bugs, viruses, Trojan horses, or similar harmful code transmitted to or through the Website by any third party; and/or
  6. Errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Website.

This limitation of liability applies whether based on warranty, contract, tort, or any other legal theory, and whether or not Alpine Motors has been advised of the possibility of such damages. The foregoing limitation shall apply to the fullest extent permitted by Singapore law.

You specifically acknowledge that Alpine Motors shall not be liable for any user submissions or for the defamatory, offensive, or illegal conduct of any third party, and that the risk of harm or damage from the foregoing rests entirely with you.

The Website is operated and offered in the Republic of Singapore. Alpine Motors makes no representation that the Website is appropriate or available for use in other locations. Those who access or use the Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

10. Indemnity

You agree to defend, indemnify, and hold harmless Alpine Motors, along with its parent company, subsidiaries, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from:

  1. Your use of or access to the Website;
  2. Your violation of any provision of these Terms of Service; or
  3. Your violation of any third party right, including without limitation any copyright, trademark, property, publicity, or privacy right.
  4. This defense and indemnification obligation will survive the termination of these Terms of Service and your use of the Website.

11. Ability to Accept Terms of Service

You affirm that you are at least 21 years of age and have the full legal capacity to enter into these Terms of Service. If you are under 21 years of age, your use of the Website must be directly supervised by your parent or legal guardian, who agrees to be bound by these Terms of Service.

12. Assignment

These Terms of Service, and any rights or licenses granted under them, may not be assigned or transferred by you without prior written consent. Alpine Motors may assign these Terms of Service, or any rights and obligations hereunder, without restriction.

13. General

You agree that:

  1. The Website is exclusively operated under and governed by the laws and regulations of the Republic of Singapore.
  2. The Website shall be deemed a passive website that does not give rise to personal jurisdiction over Alpine Motors, either specific or general, in jurisdictions outside Singapore.

These Terms of Service shall be governed by the laws of the Republic of Singapore, without regard to its conflict of laws principles. Any claim or dispute between you and Alpine Motors that arises from or relates to the Website shall be subject to the exclusive jurisdiction of the courts of Singapore.

These Terms of Service, together with the Privacy Statement and any other legal notices published by Alpine Motors on the Website, constitute the entire agreement between you and Alpine Motors concerning the Website.

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect.

No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of that term or any other term. Alpine Motors’ failure to assert any right or provision shall not constitute a waiver of such right or provision.

Alpine Motors reserves the right to amend these Terms of Service at any time without notice. It is your responsibility to review these Terms of Service periodically for changes. Your continued use of the Website following any such amendment constitutes your acceptance of the revised terms.

You agree that any cause of action arising out of or related to the Website must be filed within six (6) years after the cause of action accrues, in accordance with Singapore’s Limitation Act. Otherwise, such cause of action is permanently barred.
